As a condition of my participation in the Program, I agree to properly use the VCHECK24 monitoring app and breathalyzer provided to me by my monitoring authority, and to keep the app active on my smartphone at all times while on the program.  This includes allowing the VCHECK24 app access to my camera, Bluetooth, location services (all the time), microphone, and cellular data for the duration of my time on the monitoring program.  I understand that I may receive SMS text messages from the VCheck24 system and agree to this. In addition, I agree to keep push notifications for the app turned ON at all times.  In that regard, I will perform ALL scheduled, unscheduled/random, and system generated BrAC check-ins and keep my cell phone and breathalyzer adequately charged at all times. I further agree not to turn off or deactivate location services on my cell phone.
 
I shall perform my BrAC check-ins at times and locations as instructed, if specified by my monitoring authority.  I further understand that when a VCHECK24 or BrAC check-in is prompted, my phone may vibrate and sound a tone which is my prompt to perform a check-in and that for each check-in, I have 15 minutes to complete the check-in before it is considered late or missed.  I further agree to the foundation and admissibility of reports from the VCHECK24 program as a business record.

In addition, while participating in the Program, I agree to blow into the monitoring device at scheduled testing times (or when prompted to complete a test on a random basis) as instructed by VCHECK24. I agree not to tamper with or break the monitoring unit. I also agree to charge the monitoring unit as instructed to always keep it charged. I agree that if there is a Positive breath test for alcohol, I will continue to provide breath samples every 15-30 minutes or as prompted until a 0.00 reading is obtained. I agree that failure to do this will result in a non-compliance alert sent to the concerned party, and/or authorized representatives.
 
I understand that as a participant in the Program I am to abstain from any and all alcohol consumption, to avoid the use of products containing alcohol around the BACtrack device and to not tamper with the monitoring unit. Further, I understand that if I do violate the Monitoring Program or this Agreement it will result in notification to the Court, the concerned party, or authorized representatives. I acknowledge that I have received a copy of this Agreement and that it has been explained to me before signing. I understand that I must comply with the requirements of this Agreement until notified otherwise by VCHECK24, the court, the concerned party, or authorized representatives. 

I agree to call VCHECK24 immediately if I have any questions about this Agreement or if I experience any problems with the monitoring unit. I further understand that any violation of this Agreement will constitute notification of non-compliance of the Program and may cause immediate adverse legal action to be taken against me as described herein.
